Facts About Wills - In Contemplation of Marriage

1. Wills can be challenged by family members, which now includes de facto partners.

 

2. There are tax implications for business assets owned personally and left under a Will.

 

3. A Will can be used to facilitate transfer of assets to trusts.

 

4. Wills are revoked by marriage, unless expressed to be made in contemplating of that marriage.

5. A person can have separate Wills dealing with property in different countries.

 

6. Wills are not automatically revoked on commencement or termination of a relationship and should be reviewed at that point.
